Comcast Can't Nix Suit Over Allegedly Undisclosed Fees

Law360, New York (May 31, 2012, 5:36 PM EDT) -- A California federal judge rejected a bid from Comcast Corp. on Thursday to throw out a putative class action brought by a customer who said he was charged additional, unexpected fees after signing up for the company's "Triple Play" bundled services package.

U.S. District Judge Saundra Brown Armstrong denied Comcast's motion to dismiss Athanassios Diacakis' lawsuit, disagreeing with the company's assertion that Diacakis hadn't rectified the deficiencies that lead to the dismissal of an earlier incarnation of his complaint in January.
