FedEx Wants Declarations Back, Suit Gone

Law360 (September 12, 2007, 12:00 AM EDT) -- In steeling itself against a consolidated Indiana class action, FedEx Ground Package System Inc. on Wednesday insisted its drivers were correctly considered independent contractors, asked for a dismissal and tried once again to breathe life back into testimony the court has already stricken.

Firing back at the complaint, the shipping service contended that its delivery drivers, who plaintiffs insist are actually misclassified employees, have been correctly christened independent contractors.
