Dairy Farmer Subclass Gets Recertified In Antitrust MDL

Law360, New York (June 1, 2012, 6:12 PM EDT) -- A Tennessee federal judge on Friday recertified a subclass of dairy farmers in their antitrust class action against various food providers, saying they had replaced the counsel they once shared with another subclass and that the conflict between the two was resolved.

U.S. District Judge J. Ronnie Greer rejected the argument brought by Dairy Farmers of America Inc. and other defendants that there was still an intraclass conflict that precluded recertification because because some members claimed to have been harmed by the same conduct that benefited other class members.
