Breaking Down Fla.'s Prejudgment Interest Issues

Law360, New York (June 7, 2012, 1:08 PM EDT) -- Under Florida law, a plaintiff that wrongfully has been deprived of a contractually due payment generally is entitled, as a matter of law, to prejudgment interest at a statutorily prescribed rate from the date that payment became due.

In the insurance context, the issue concerns the payment of disputed proceeds to which the insured is later deemed entitled under the terms of the policy. The date the payment becomes due generally depends on the policy provisions.
