Drug Promoters Say Genentech Shorted Them On OT

Law360, New York (June 4, 2012, 1:04 PM EDT) -- Genentech Inc. was hit Friday with a proposed class action in Arizona federal court by an employee who says the company shorts its drug promoters on overtime pay by misclassifying them as exempt.

Genentech pharmaceutical representative Belgium Harris says in his putative collective action that the drugmaker systematically misclassifies its promoters as exempt from the overtime provisions of the Fair Labor Standards Act despite the fact that the workers do not themselves sell Genentech products as the company contends.
