Blue Shield Must Cover Residential Anorexia Care: 9th Circ.

Law360, New York (June 5, 2012, 2:13 PM EDT) -- Blue Shield of California has to pay for an anorexic woman’s 9 1/2-month stay at a residential treatment center because of a state law intended to ensure mentally ill patients receive similar care as those with physical ailments, the Ninth Circuit ruled Monday.

The majority decision revised an opinion issued by the court last year, but the altered legal reasoning didn’t change the outcome, prompting a strident partial dissent from one judge.
