Big Pharmas Cite Elevator Ruling To Boost Case

Law360 (September 12, 2007, 12:00 AM EDT) -- Sixteen prominent pharmaceutical manufacturers have pointed to a recent appellate decision as further proof that they should be dismissed from a Long Island-based drug wholesaler's $2.3 billion antitrust suit.

A lawyer at Gibson, Dunn & Crutcher LLP sent a letter Wednesday on behalf of all the manufacturer-defendants to a judge in the U.S. District Court for the Eastern District of New York referring him to the U.S. Court of Appeals for the Second Circuit's Sept. 4 decision in In re Elevator Antitrust Litigation.
