Judge Tosses Some Claims In Merck Race Bias Suit

Law360 (September 12, 2007, 12:00 AM EDT) -- In a boost to Merck & Co., a federal judge has tossed certain claims in a race discrimination putative class action lawsuit brought against the pharmaceutical giant, but has given the plaintiffs leave to file a revised amended complaint.

In a memorandum and order handed down Wednesday in the U.S. District Court for the Eastern District of Pennsylvania, Judge Bruce W. Kauffman granted in part and denied in part Merck’s motion to dismiss the plaintiffs’ second amended complaint.
