Judge Advances Pharmacy's Medicare Fight With Humana

Law360, New York (June 6, 2012, 7:05 PM EDT) -- A Florida federal judge on Tuesday refused to dismiss a putative class action against Humana Inc. accusing the company of refusing to reimburse customers for drugs purchased at small, independently owned pharmacies across the country in violation of Medicare Part D provisions.

Judge William Zloch of the Southern District of Florida refused to dismiss the case, saying he wanted to give both parties the chance to go through discovery and make motions for summary judgment.
