Ex-Vitesse Execs Push For Acquittal Following Fraud Mistrial

Law360, New York (June 5, 2012, 8:47 PM EDT) -- The former CEO and chief financial officer of Vitesse Semiconductor Corp., whose trial on charges of revenue misstatement and options backdating ended in a mistrial in April, asked a New York federal judge Tuesday to acquit them.

The charges against Louis Tomasetta, Vitesse's ex-CEO, and Eugene Hovanec, its ex-CFO, are too poorly founded to go to trial again, the men's lawyers said at a hearing before U.S. District Judge Paul A. Crotty.
