CNA Escapes Asarco's $33M Superfund Cleanup Suit

Law360, New York (June 7, 2012, 7:43 PM EDT) -- A California federal judge on Wednesday dismissed mining giant Asarco LLC’s efforts to recoup up to $33 million in cleanup costs from chemical company CNA Holdings LLC for a Superfund site, finding the claim was time-barred because of a 1989 settlement.

Asarco sued CNA Holdings, along with three other defendants, in California federal court March 2011, seeking a contribution for costs incurred under the Comprehensive Environmental Response, Compensation and Liability Act for cleaning a 66-acre parcel in northern California known as the Selby Site.
