EPA Will Approve Texas Air Quality Plan

Law360, New York (June 7, 2012, 10:01 PM EDT) -- The U.S. Environmental Protection Agency said Thursday it planned to approve revisions to Texas' statewide implementation plan for federal air quality standards, following the Fifth Circuit's ruling that the agency lacked legal grounds for rejecting the plan.

The EPA said the revised plan submitted by the Texas Commission on Environmental Quality made the state-issued permits more clear and enforceable while also providing industries with flexibility to meet Clean Air Act requirements.
