Imation’s DVD Patent Suit Victory Vacated By Fed. Circ.

Law360, New York (June 11, 2012, 6:03 PM EDT) -- The Federal Circuit on Monday vacated a ruling that rewritable DVDs made by Imation Corp. and others do not infringe two Toshiba Corp. patents, finding that the lower court wrongly held that induced infringement cannot be found if a product has substantially noninfringing uses.

"The district court erred as a matter of law," the Federal Circuit wrote. "The existence of a substantial noninfringing use does not preclude a finding of inducement."
