NuvaRing Plaintiffs Battle Organon Over Jurisdiction

Law360, New York (September 14, 2007, 12:00 AM EDT) -- Consumers suing Organon Inc. over its contraceptive device, NuvaRing, want the case remanded back from whence it came, arguing the pharmaceutical company had no cause to remove it to federal court.

In motions filed on Thursday in the U.S. District Court for the District of New Jersey, the plaintiffs said that, contrary to Organon's claims, there was no federal question to be decided and no reason the case should not be heard in state court, where the action was originally filed.
