Fed. Circ. Says DOE Doesn't Owe Entergy Waste Disposal Costs

Law360, New York (June 14, 2012, 8:38 PM EDT) -- The Federal Circuit ruled Wednesday that an Entergy Corp. unit can't recoup the extra $14.2 million it paid to store spent nuclear fuel from the Vermont Yankee Nuclear Power Station, despite the U.S. Department of Energy's reneging on a contract to dispose of the fuel.

The three-judge panel partially reversed a Court of Federal Claims decision that dealt with costs beyond the $35 million the DOE had already agreed to pay for Entergy unit Entergy Nuclear Vermont Yankee LLC for the construction of a spent-fuel storage facility....
