Aredia Case Belongs In State Court: Magistrate Judge

Law360, New York (September 17, 2007, 12:00 AM EDT) -- A magistrate judge has recommended that two plaintiffs be allowed to remand their lawsuit against Novartis Pharmaceuticals Corp. to state court to pursue their product liability claims over bone cancer drugs Aredia and Zometa.

Magistrate Judge Joe Brown on Thursday agreed with the plaintiffs' argument that the case belonged in New Jersey state court because Novartis' headquarters are based in the state.

But the judge recommended that the plaintiffs be denied their motion for attorneys' fees, saying they are not entitled to the costs they incurred...
