Part Of Pollution Case Moot: American Electric

Law360 (September 17, 2007, 12:00 AM EDT) -- American Electric Power Company Inc. and its subsidiary, Southwestern Electric Power Co., asked a federal judge on Friday to throw out certain claims in an environmental lawsuit accusing the energy generators of polluting the air near a plant in Eastern Texas.

The company insisted that the Texas Commission on Environmental Quality had recently altered the conditions of its air quality permit for the Welsh Plant so that the plant's emissions were now under state limits.

The new request follows the plaintiffs' motion to oppose the company's first request to dismiss the claims in mid-August.
