California, Feds Differ On "Exempt" Administrators

Law360, New York (September 17, 2007, 12:00 AM EDT) -- In Eicher v. Advanced Business Integrators, Inc., 151 Cal.App.4th 1363 (Case No. C051746, June 12, 2007), a California appellate court held a “Senior Consultant” employee of a software company was not exempt under California’s administrative exemption, awarding unpaid overtime wages, penalties, and attorneys’ fees.

In so doing, the California courts once again highlighted the differences between Federal and California law with respect to the scope of the administrative exemption.
