Apotex Bid To Overturn Prilosec Decision Denied

Law360 (September 17, 2007, 12:00 AM EDT) -- A District of Columbia judge has refused to overturn a federal agency decision that blocked drug manufacturer Apotex Corp. from marketing a generic version of gastric-acid-inhibiting drug Prilosec because it infringed on Astrazeneca AB patents.

U.S. District Judge Ricardo M. Urbina ruled on Monday that Apotex had failed to show that it would likely win its case against the U.S. Food and Drug Administration and denied the generic drug maker's request for a preliminary injunction or restraining order against the federal agency.
