Calif. Cap-And-Trade Plan Gets Appeals Court's OK

Law360, New York (June 20, 2012, 3:40 PM EDT) -- A California appeals court on Tuesday upheld the state Air Resources Board's plan to reduce greenhouse gas emissions through a cap-and-trade system, ruling that the board satisfied state environmental requirements in developing the scoping plan.

A group of environmental advocates led by the Association of Irritated Residents alleged that the ARB violated state law by failing to achieve the maximum feasible cost-effective reductions in greenhouse gases and did not properly consider alternative options.
