Lawmakers Seek To Undo High Court's Dukes Ruling

Law360, New York (June 20, 2012, 7:38 PM EDT) -- Congressional leaders on Wednesday proposed legislation designed to combat the restrictions on class action discrimination suits established last year by the U.S. Supreme Court's Wal-Mart Stores Inc. v. Dukes ruling.

Exactly one year after the high court handed down its split majority Dukes decision, Sen. Al Franken, D-Minn., and U.S. Rep. Rosa DeLauro, D-Conn., introduced the Equal Employment Opportunity Restoration Act, which if enacted would liberalize the standards under which individuals may pursue relief on behalf of a group in discrimination lawsuits.
