NJ High Court Reins In Defense Against Late-Filed Cases

Law360, New York (June 21, 2012, 10:53 PM EDT) -- The New Jersey Supreme Court ruled Wednesday that defendants can't escape a lawsuit by arguing the plaintiff's delay in filing suit put them at an unfair advantage as long as the case was filed within the statute of limitations, a decision attorneys say will provide added certainty over the timeliness of cases and limit the use of that commonly pled defense.
