Ecuador Claims Chevron Can't Pursue Claims

Law360, New York (September 18, 2007, 12:00 AM EDT) -- Ecuador has asked a federal court judge to toss its lawsuit against ChevronTexaco Corp., arguing that since the oil giant is barred from taking the country and its state-owned petrol company to arbitration, the judge no longer has jurisdiction in the case.

Since Ecuador chucked its remaining complaints in July, shortly after winning a permanent block on arbitration, a previous order stating that Chevron's counterclaims were allowed under an exception in the Foreign Sovereign Immunities Act is now moot, the state said Monday in a memorandum...
