Encysive Wins Dismissal Of Securities Suit

Law360, New York (September 18, 2007, 12:00 AM EDT) -- A federal judge has dismissed a proposed class action lawsuit that accused Encysive Pharmaceuticals Inc. of misleading investors about the prospects for its pulmonary arterial hypertension treatment Thelin.

Judge Nancy F. Atlas of the U.S. District Court for the Southern District of Texas ruled Tuesday that the plaintiffs had failed to state a claim upon which relief could be granted and that they did not raise an issue of scienter.
