FDNY Bias Ruling Relied On Scant Proof, NYC Tells 2nd Circ.

Law360, New York (June 26, 2012, 7:47 PM EDT) -- Lawyers for New York City asked the Second Circuit on Tuesday to overturn a court-ordered clampdown on alleged racism in the fire department's hiring practices, saying a lower court judge had insufficient evidence to find discrimination.

A city lawyer told a three-judge panel that U.S. District Judge Nicholas G. Garaufis ignored evidence about FDNY's efforts to recruit black and Hispanic candidates when he found that the fire department was a hotbed of racism.
