EU Can Sue Elevator Price-Fixers Despite Prior Fine: Adviser

Law360, New York (June 26, 2012, 1:27 PM EDT) -- The European Commission shouldn't be barred from bringing a price-fixing lawsuit in a Belgium court against elevator companies that the commission itself fined, a chief legal adviser to Europe's highest court said Tuesday.

Advocate General Cruz Villalón told the European Court of Justice that the commission should be able to sue Otis Elevator Co. and ThyssenKrupp AG for damages for jacking up prices on elevators installed in European Union buildings, even though the Belgian court case is based on the watchdog's own finding that the companies...
