Covidien Sales Reps' OT Suit Nixed By High Court GSK Ruling

Law360, New York (June 28, 2012, 1:17 PM EDT) -- Covidien Inc. on Wednesday escaped a putative class action from pharmaceutical sales representatives who allege the company misclassified them as exempt from overtime laws, following the U.S. Supreme Court’s decision in Michael Shane Christopher et al. v. Smithkline Beecham Corp.

In light of the Supreme Court’s June 18 decision, U.S. District Judge Curtis L. Collier lifted a stay in the case and granted Covidien’s motion for summary judgment, finding that Covidien sales representatives are not entitled to receive overtime pay.
