4th Circ. Tosses Donors' Dismissal That Cited Citizens United

Law360, New York (June 28, 2012, 10:29 PM EDT) -- The Fourth Circuit on Thursday reversed a lower court's dismissal of a charge against two Galen Capital Group LLC executives accused of making direct corporate contributions to a federal campaign on the grounds that the law applied was unconstitutional in the light of 2010's Citizens United decision.

The Fourth Circuit panel based much of its decision to reverse on Federal Election Commission v. Beaumont, a 2003 case in which, the panel noted, the Supreme Court rejected an as-applied challenge to the ban on direct corporate contributions....
