Boeing Not Owed Defense Costs In Contract Suit, DOE Says

Law360, Washington (July 10, 2012, 2:46 PM EDT) -- The U.S. Department of Energy told the Federal Circuit on Tuesday that Boeing Co. and its predecessor Rockwell International Corp. didn't faithfully fulfill a nuclear power plant maintenance contract and aren't entitled to defense reimbursement for a mixed-verdict whistleblower suit.

While a federal jury did determine that Rockwell made False Claims Act violations in connection with its government contract to maintain the Rocky Flats nuclear power plant in Colorado, the company wasn't liable due to the allegations initially made by a former employee. That decision prompted...
