5th Circ. Frees Nautilus From Oil Project Coverage Fight

Law360, New York (June 29, 2012, 8:29 PM EDT) -- Nautilus Insurance Co. does not have to pick up the tab for litigation over a botched oil drilling project brought against policyholder Downhole Navigator LLC after Downhole turned down the chance to be represented by attorneys hand-picked by the insurer, the Fifth Circuit ruled Friday.

Downhole had sought defense from Nautilus under a commercial general liability policy for a March 2009 lawsuit alleging the driller had damaged an oil well. The Arizona-based insurer agreed to defend the company, but reserved its rights, saying the alleged damages...
