High Court To Take On Energy Contract Spat

Law360, New York (September 25, 2007, 12:00 AM EDT) -- After a see-saw battle in the lower courts, the U.S. Supreme Court has decided to wade into the controversy surrounding the numerous wholesale power contracts that were assigned during the height of the California energy crisis.

On Tuesday, the High Court granted writ of certiorari to Morgan Stanley Capital Group and Calpine Energy Services, two of the power companies seeking appeals in the wake of an appellate order forcing the Federal Energy Regulatory Commission to review the contracts penned during that tumultuous time.
