No Federal Jurisdiction For Zyprexa Suit: Montana

Law360 (September 26, 2007, 12:00 AM EDT) -- Montana wants its suit over Zyprexa, the antipsychotic whose alleged dangers have led maker Eli Lilly & Co. to shell out billions to plaintiffs, separated from the consolidated federal action and sent back to state court.

In filing a motion and briefs on Tuesday in the eastern New York district court where the multidistrict litigation is pending, Montana attorney general Mike McGrath insisted that court precedent in the nationwide litigation over the drug indicated that attorney generals' claims against Lilly should be remanded.
