FERC Won't Give Private Energy Co. Slice Of $235M Settlement

Law360, New York (July 13, 2012, 1:37 PM EDT) -- The Federal Energy Regulatory Commission refused Wednesday to award waste-to-energy company Innovative Energy Systems Inc. a portion of FERC's $235 million settlement with Constellation Energy Commodities Group over allegedly manipulative energy market transactions, finding IES ineligible as a nonstate entity.

IES had argued that the terms of the March agreement were ambiguous as to the allocation and distribution of the funds. As a buyer and seller of energy in the affected markets, the company contended it suffered significant financial harm as a result of Constellation's actions...
