High Court Rebuffs Challenge To ERISA Case

Law360, New York (September 27, 2007, 12:00 AM EDT) -- The U.S. Supreme Court has denied a motion to dismiss a pending case on 401(k) liability, unmoved by the respondents' contention that the suit is moot given the plaintiff's withdrawal of all his funds from the defined benefit account in dispute.

On Monday, the High Court rejected a motion to dismiss the writ of certiorari previously granted to James LaRue while giving its blessing to the Solicitor General to participate in oral argument as amicus curiae, according to the order.
