Citgo Asks 5th Circ. To Nix Appeal Of $6M Oil Spill Fine

Law360, New York (July 17, 2012, 6:30 PM EDT) -- Citgo Petroleum Corp. on Monday urged the Fifth Circuit to dismiss the federal government’s quest for a fine higher than the $6 million penalty a Louisiana federal judge issued in response to a June 2006 oil spill, saying the court doesn't have subject matter jurisdiction.

Citgo argued the instant case, brought by the U.S. and the state of Louisiana, should be tossed because Louisiana already filed an administrative action over the same spill at the time the present suit was launched, and the Clean Water Act...
