Bill Would Give Federal Circuit Exclusive Jurisdiction In Patent Counterclaims

Law360 (June 23, 2005, 12:00 AM EDT) -- The U.S. House of Representatives is considering a bill that would give the U.S. Court of Appeals for the Federal Circuit exclusive jurisdiction over appeals of patent counterclaims from district courts.

The bill, dubbed the “Intellectual Property Jurisdiction Clarification Act of 2005” (H.R. 2955), was introduced Tuesday by Rep. Lamar Smith of Texas.

As Chairman of the House Subcommittee on Courts, the Internet, and Intellectual Property, Smith was instrumental in drafting a sweeping patent reform proposal currently being considered by the U.S. House of Representatives....
