CIT Nixes Furniture Co.'s Suit Over Chinese Daybed Duties

Law360, New York (July 18, 2012, 4:50 PM EDT) -- The U.S. Court of International Trade on Wednesday tossed out importer Acme Furniture Industry Inc.'s case after rejecting its claim that it was due a full refund for anti-dumping duties imposed on Chinese daybeds found not to be covered by the applicable duty order, and tossed out Acme's case.

The U.S. government successfully moved to have the two-count complaint — one of several Acme has lodged over Chinese daybeds — dismissed, arguing that the court lacked jurisdiction and alternatively that Acme failed to state a claim...
