11th Circ. Revives Mortgage Co. Suit Over Collection Tactics

Law360, New York (July 18, 2012, 2:59 PM EDT) -- The Eleventh Circuit on Wednesday revived a Florida couple's Fair Debt Collection Practices Act suit against American Home Mortgage Servicing Inc. over alleged harassing phone calls and home inspections, ruling that the company may be held liable under the law for debt collection activities.

Homeowners Angela and Paul Birster accused American Home Mortgage of violating the FDCPA by unleashing a "relentless assault" on them in pursuit of mortgage payments, including multiple phone calls per day in which the company used abusive language and frequent home inspections...
