Warranty, State Claims Pared In Porsche Cooling Tube MDL

Law360, New York (July 20, 2012, 7:53 PM EDT) -- An Ohio federal judge on Thursday dealt a blow to a nationwide class in multidistrict litigation accusing Porsche Cars North America Inc. of knowingly installing faulty plastic cooling tubes in its Cayenne models, slashing express warranty claims while retaining implied warranty claims for four states.

U.S. District Judge Gregory Frost tossed all nationwide express warranty claims brought against Porsche under the Magnuson-Moss Federal Warranty Act and excised six of the 10 plaintiff states' implied warranty claims in response to Porsche's motion to dismiss.
