Canada Upholds Viagra Patent Over Apotex' Protests

Law360, New York (September 28, 2007, 12:00 AM EDT) -- Pfizer Inc. scored another victory in its worldwide fight to hang onto the rights to Viagra on Thursday when a Canadian court shot down Apotex Inc.' bid to get the patent for it invalidated.

Toronto-based generics maker Apotex had sued earlier this year in the Toronto federal court seeking a judgment declaring the patent, Canadian Patent No. 2,163,446, invalid so that it could proceed with the launch of its own version of the hit erectile dysfunction drug.
