DC Circ. Upholds Emissions Exemption For Ethanol Plants

Law360, New York (July 20, 2012, 2:20 PM EDT) -- The D.C. Circuit on Friday refused to overturn a U.S. Environmental Protection Agency rule allowing certain recently constructed ethanol plants to skirt greenhouse gas reduction standards, finding that the meat producer industry association petitioners could not show that a stricter GHG policy would cause corn prices to drop.

The industry groups — the National Chicken Council, the National Turkey Federation and the National Meat Association — challenged the EPA's decision to indefinitely exempt ethanol plants that began construction in 2008 or 2009 from the statutory standard...
