Texas Judge Orders Review Of Air Permit For $3B Power Plant

Law360, New York (July 20, 2012, 8:42 PM EDT) -- A Texas state judge on Thursday ruled that the Texas Commission on Environmental Quality must reconsider a permit it issued approving a $3 billion, 1,300-megawatt coal-fired power plant in Corpus Christi, using current air quality standards for sulfur dioxide and nitrogen dioxide emissions.

Thursday's decision follows Judge Stephen Yelenosky's May finding that TCEQ failed to abide by federal and state law when it issued a permit in January 2011 for construction of the Las Brisas Energy Center LLC without a demonstration from the plant operators of...
