No Quick Win For DuPont In Monsanto Seed Patent Dispute

Law360, New York (July 23, 2012, 1:08 PM EDT) -- A Missouri federal judge on Friday denied a motion from DuPont Co. asking the court to find that the company had not willfully infringed a Monsanto Co. patent on genes for herbicide-resistant seeds.

In a written order that formalized one he had given orally in court, U.S. District Judge E. Richard Webber said that Monsanto had presented sufficient evidence to suggest to a “reasonable” jury that DuPont had willfully infringed the patent, which covers technology for producing crops that are resistant to Monsanto's popular “Roundup” herbicide....
