Insurers Win Over 10th Circ. In E. Coli Coverage Fight

Law360, New York (July 23, 2012, 3:38 PM EDT) -- The Tenth Circuit on Friday limited insurance coverage for claims against an Oklahoma restaurant over a 2008 E. coli outbreak that sickened more than 300 people and killed one, determining there had been only one occurrence under each policy.

Republic Underwriters Insurance Co. and Southern Insurance Co. persuaded the appeals court to overturn a magistrate judge's determination that there had been two occurrences under their primary and umbrella policies because the E. coli-contaminated food was prepared by Country Cottage Restaurant at two different locations.
