Over-50 Age Bias Class Can't Be Appealed Yet, Judge Says

Law360, New York (July 23, 2012, 8:41 PM EDT) -- A Pennsylvania federal judge held Friday that an appeal of the conditional certification of a class of workers over 50 for age discrimination claims would be premature, even though the Third Circuit has never decided whether such a subgroup of statutorily-protected employees can allege a disparate impact.
