Ford's Win In Freestar Fire Suit Affirmed By NJ Court

Law360, New York (July 23, 2012, 5:49 PM EDT) -- A New Jersey appellate court on Monday sided with Ford Motor Co. in State Farm Indemnity Co.'s lawsuit alleging breach of warranty and strict liability over a used 2006 Ford Freestar that burst into flames, backing the use of certain evidence which showed the applicable limitations period had expired.

State Farm, suing as subrogee of car owner Ricardo Diaz, unsuccessfully argued on appeal that a 2011 trial court decision granting summary judgment to Ford was based on hearsay evidence and should be reversed.
