Tenn., Texas, Others Bring EPA Smog Rules Fight To DC Circ.

Law360, New York (July 23, 2012, 8:22 PM EDT) -- Texas and Tennessee are among a group of petitioners suing the U.S. Environmental Protection Agency on Thursday in the D.C. Circuit over the recent designation of 46 locations across the country, including areas surrounding the cities of Memphis and Dallas, as noncompliant under the agency's smog rules.

The states were joined by at least eight other groups on Thursday and Friday in a series of independent petitions asking the appeals court to review the EPA's final rule, which lists national regions where levels of ozone exceed...
