Judge Quashes Indictment In DuPont Trade Secrets Case

Law360, New York (July 24, 2012, 9:03 PM EDT) -- A California federal judge on Monday said U.S. prosecutors had failed to properly serve an indictment accusing Pangang Group Co. Ltd. and its subsidiaries of conspiring to steal DuPont Co. trade secrets, dealing a blow that may end the case against the Chinese state-owned enterprise.

In an order quashing the indictment Monday, U.S. District Judge Jeffrey White said the New Jersey-based Pangang Group affiliate Pan America Inc. is not an agent of the larger enterprise for service to be effective under federal delivery requirements.
