8th Circ. Upholds Suicide Advisory In SD Abortion Law

Law360, New York (July 24, 2012, 8:39 PM EDT) -- The Eighth Circuit on Tuesday upheld a South Dakota law requiring physicians to disclose an increased risk of suicide to patients seeking abortions, ruling that the requirement is not unconstitutionally misleading.

In a 7-4 en banc decision, the appeals court rejected Planned Parenthood's argument that disclosure of an increased suicide risk is misleading because no evidence shows a causal link between abortion and suicide.
