Visto Holds Firm On Presumption Of Validity Dispute

Law360, New York (October 2, 2007, 12:00 AM EDT) -- Visto Corp. asked a federal judge Monday to reject Microsoft Corp.'s request to bar Visto from discussing the principle of presumption of validity with the jury in their ongoing case over e-mail patents.

Visto filed a rapid response to Microsoft's request in the U.S. District Court for the Eastern District of Texas, saying that federal and case law both argued for allowing Visto to inform the jury of the allegedly prevailing principle that a patent is valid unless there is “clear and convincing” evidence otherwise....
